1. Acceptance of Terms
By using this website or requesting services from Bauer's Tree & Stump Removal, you agree to these terms. If you do not agree, do not use the site.
2. About Our Services
We provide tree removal, stump grinding, tree trimming and pruning, storm damage and emergency tree work, dead and hazardous tree removal, and lot clearing in and around Lake City, Minnesota.
3. Estimates and Pricing
Information on this website, including any price ranges, is general and for planning only. It is not a quote or an offer. A binding price exists only in a written estimate we provide for your specific property after an on-site visit. Estimates are valid for 30 days unless stated otherwise. If conditions turn out to differ materially from what was visible at the estimate — hidden rot, a concealed hazard, buried debris, unexpected access limits — we will stop and discuss revised pricing with you before continuing.
4. Scheduling, Weather and Delays
Tree work depends on weather and ground conditions. We may reschedule for high wind, storms, lightning, saturated ground, or other safety reasons, and we are not liable for losses caused by such delays. Emergency and storm work is scheduled by severity and may displace routine appointments.
5. Property Owner Responsibilities
Before work begins you agree to:
- Confirm you own the property or have the owner's written permission for the work, including for any tree on or near a property line.
- Identify and mark anything buried or hidden that we could not reasonably see, including septic tanks and drain fields, private wells and water lines, irrigation and sprinkler systems, invisible pet fences, landscape lighting, low-voltage wiring, propane lines, and private utility lines.
- Point out property lines and any trees you do not want touched.
- Move vehicles, equipment, furniture, and other valuables out of the work area and keep people and pets clear while we work.
- Obtain any required permits or HOA approvals unless we have agreed in writing to handle them.
We will contact Gopher State One Call (811) for public utility locates where required. 811 locates do not cover privately owned lines. We are not responsible for damage to unmarked or inaccurately marked private lines or buried items.
6. Unavoidable Effects of Tree Work
Even with care, tree and stump work can leave marks. Equipment can leave ruts or compact turf, especially on soft ground. Removing a tree or grinding a stump disturbs the soil and surrounding lawn and may damage nearby roots, plantings, or turf. Falling limbs can mark a lawn. Grindings and chips are normally left on site and backfilled into the stump hole unless we agree otherwise in writing. These are expected results of the work and are not defects. Lawn repair, reseeding, grading, and landscape restoration are not included unless listed in your written estimate.
7. Cleanup and Debris
Unless your written estimate says otherwise, we remove branches, brush, and wood debris generated by the work and rake the work area. Hauling of large rounds or logs, firewood splitting and stacking, and removal of pre-existing debris are not included unless stated.
8. Tree Health and No Guarantee of Survival
Pruning, trimming, and cabling are performed using accepted practices, but trees are living things affected by disease, insects, drought, storms, and soil conditions. We do not warrant that any tree will survive, remain healthy, or remain standing after our work. We make no guarantee that a tree will not fail in a future storm.
9. Hazardous and Emergency Work
Removing damaged, dead, or storm-fallen trees carries risk that cannot be eliminated. Where a tree is already compromised, additional damage can occur during removal despite reasonable care, and you accept that risk by authorizing the work.
10. Payment
Payment is due on completion unless your written estimate states different terms. A deposit may be required for larger jobs. Accepted payment methods will be confirmed in your estimate. Past due balances may be subject to late charges and reasonable collection costs permitted by law.
11. Cancellation
Please give us as much notice as possible. If you cancel after we have mobilized equipment or crew to your property, we may charge for costs already incurred.
12. Insurance
We carry liability insurance and workers' compensation coverage as required by law. A certificate of insurance is available on request.
13. Limitation of Liability
To the fullest extent allowed by law, our total liability arising out of any project is limited to the amount you paid us for that project. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of use, loss of property value, or lost income. Nothing in these terms limits liability that cannot be limited under Minnesota law.
14. Claims and Notice
You agree to notify us in writing of any claim of damage within 14 days of the work and to give us a reasonable opportunity to inspect the property and address it before any repair is made by others.
15. Website Use and Content
All text, photographs, logos, and other content on this site belong to Bauer's Tree & Stump Removal or its licensors and may not be copied or reused without permission. You agree not to misuse the site, interfere with its operation, or submit false information through our forms.
16. No Professional Advice
Content on this site is general information about tree care, not a professional assessment of any specific tree or property. Decisions about a specific tree should be based on an on-site inspection.
17. Governing Law and Venue
These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Wabasha County, Minnesota, and both parties consent to that venue.
18. Severability
If any provision is found unenforceable, the rest remains in effect.
19. Changes to These Terms
We may update these terms. The current version is always posted on this page.
